01
General terms and conditions

1.1
The following Provisions on the academic council of FSBI “NMRC RB” of the Ministry of Health of Russia (hereinafter referred to as – the Provisions) defines the status, objectives, tasks, procedure of formation and approval of the membership, powers, organization of activities of the Academic council of FSBI “NMRC RB” of the Ministry of Health of Russia.

1.2
Full name: the Academic council of the federal state budgetary institution “National medical research center for rehabilitation and balneology” of the Ministry of Health of the Russian Federation.

1.3
Short name: the Academic council of FSBI “NMRC RB” of the Ministry of Health of Russia (hereinafter referred to as – of the Academic council).

1.4
The academic council is established for the purpose of considering the main issues of research, research and organizational and HR activities of FSBI “NMRC RB” of the Ministry of Health of Russia (hereinafter referred to as – the Institution).

1.5
The Academic council operates in accordance with the current laws of the Russian Federation, including Federal Law No 127- ФЗ "About science and the state scientific and technical policy", Federal Law No 273- ФЗ of 29.12.2012 "About education in the Russian Federation",
Order of the Ministry of Education and Science of Russia of 02.09. 2015 No. 937 "About approval of the list of positions of scientific workers to be filled by a competition and the procedure for holding such a competition", the order of the Ministry of Education and Science of Russia No. 749 of 23.07.2015 "About approval of the provision on the order of filling positions of teaching staff related to the teaching staff", the Charter, orders and instructions of the Institution, as well as these Provisions and internal documents of the Academic council.

The Academic council is a permanent advisory collective body of the Institution, which operates on a voluntary basis and is not a structural subdivision of the Institution.

1.7
The main forms of work of the Council are meetings at which decisions of the Academic council are taken.

1.8
The decisions of the Council are non-regulatory and the Institution may issue orders and instructions for their implementation.

Main tasks and functions of the Academic council
-
2.1
The main tasks of the Academic council are:
-
2.1.1
Preparing proposals for priority areas for research in medical rehabilitation and balneology;
-
2.1.2
Development and approval of the Institution's research and scientific-technical work plans;
-
2.1.3
Shaping and ensuring the implementation of scientific policy in the field of medical rehabilitation and balneology, in view of the Institution's functions as the leading National Medical Research Centre for Rehabilitation and Balneology of the Ministry of Health of Russia.

2.2
The Academic council, in accordance with assigned tasks, discharges the following main functions:
-
2.2.1
Provides medium- and long-term forecasts for the development of research in the field of medical rehabilitation and balneology;
-
2.2.2
Participates in the preparation of proposals for forecasts, federal targeted scientific-technical and sectorial research programmes on problems of medical rehabilitation and balneology, and in the evaluation of the effectiveness of their implementation;
-
2.2.3
Participates in compiling a list of important areas of research and development, and in drafting proposals on priority areas of research in medical rehabilitation and balneology for the formation of state assignments for the relevant institutions subordinate to the Russian Ministry of Health;
-
2.2.4
Participates in analyzing the results and formulating recommendations for the further development of research topics carried out within the frames of the state task in the field of medical rehabilitation and balneology, including the feasibility of implementing their results;

2.2.5
Participates in the development and updating of a list of innovative products and technologies for implementation in practical healthcare, including on the basis of international practices;
-
2.2.6
Participates in the scientific and methodological supervision and defining the subjects of qualifying works for academic degrees in speciality 14.03.11 “Restorative medicine, sports medicine, exercise therapy, balneology and physiotherapy” in institutions subordinate to the Ministry of Health, as well as in medical institutions of other departments and of various forms of ownership, in accordance with the list of current areas of research and development;

Participates in formulating the recommended topical research areas for qualifying papers for degrees in speciality 14.03.11 “Restorative medicine, sports medicine, exercise therapy, balneology and physiotherapy”;

2.2.8
Participates in the methodological support of medical rehabilitation and balneology training, development of educational programmes for residency, postgraduate, further training and professional retraining;
-
2.2.9
Develops, makes decisions on the basis of state assignments, and submits for approval to the Director of the Institution research areas for the development of the Institution, with due regard to its scientific and economic interests;

2.2.10
Discusses the plans and reports of the Institution's researchers on business trips abroad, research activities carried out within the frames of international agreements on cooperation in science and technology and research;
-
2.2.11
Promotes scientific congresses, conventions, conferences, symposia and other events facilitating R&D;
-
2.2.12
Promotes the use of the Internet in the scientific activities of the Institution;
-
2.2.13
Facilitates awareness-raising and promotion of advanced technologies in the field of rehabilitation and balneology in the foreign and domestic markets;
-
2.2.14
Ensures that the procedure for competitions to fill vacant research and teaching staff positions at the Institution or for re-election for a new term, in accordance with the established procedure, is carried out;
-
2.2.15
Prepares proposals for publication plans for scientific papers, ensures that they are peer reviewed;
-
2.2.16
Establishes editorial boards for the preparation of scientific papers, practical guides and scientific information materials for publication;
-
2.2.17
Consider matters regarding the secondment of the scientific staff of the Institution abroad for a period of more than three (3) months;
-
2.2.18
Reviews materials on the awarding of academic titles for submission to the Higher Attestation Commission;
-
2.2.19
Prepare and submit, in accordance with the established procedure, proposals for awarding honorary titles of “Honoured physician of the Russian Federation” and “Honoured scientist of the Russian Federation” to the scientific staff of the Institution, as well as for awarding state prizes in the field of science;

2.2.20
Considers matters of research cooperation with other research organizations, evaluates their effectiveness and proposes areas of cooperation to the Director of the Institution for consideration.

Procedures for the formation and operation of the Academic council

3.1
The Academic council is composed ex officio of the director of the Institution, the deputy director of the Institution for research activities, the academic secretary of the Institution, as well as the heads of the branches of the Institution.

3.2
The Academic council consists of the chairperson, vice-chairperson, secretary and members of the Academic council.
-
3.3
The Academic council shall be chaired by the director or his/her deputy for research activities.
-
3.4
The members of the Academic council are approved by order of the Institution, while the members are selected from among the leading scientists and specialists of the Institution. A new member of the Academic council shall be appointed by the Institution in place of the retired member of the Academic council.

3.5
The chairperson of the Academic council, the vice-chairperson and the secretary of the Academic council have the right to vote when decisions are taken by the Academic council and perform other functions in accordance with these Provisions.

3.6
The members of the Academic council have equal rights when discussing and deciding on matters on the agenda of a meeting of the Academic council.

3.7
It is compulsory for members of the Academic council to attend the meetings in person. The members of the Academic council may not delegate their authority to anyone.
If a member of the Academic council is unable to attend a meeting of the Academic council, he or she shall inform the secretary of the Academic council in writing in advance of the meeting of the reason for absence and submit his or her opinion on the issues under consideration. Such an opinion shall not be regarded as a vote of the absent member of the Academic council on the items on the agenda of the meeting.

3.8
The Academic council meets at least once every two (2) months.

3.9
The work of the Academic council is carried out according to a plan for half a year, which is reviewed by the Academic council and approved by the Director of the Institution.

3.10
The Academic council is competent to take a decision if at least half of the members of the Academic council are present at the meeting.

3.11
A meeting of the Academic council is recorded in minutes, which should include the following:
-
3.11.1
Time and place of the meeting, details of the attendance of members of the Academic council and persons invited to the meeting;
-
3.11.2
List of items on the agenda of the meeting;
-
3.11.3
The actions of the Academic council in the order in which they took place during the Academic council meeting and their outcome;
-
3.11.4
Issues put to the members of the Academic council for a vote and the result of the vote;
-
3.11.5
The wording of the decisions adopted by the Academic council;
-
3.11.6
Signatures of the chairperson of the Academic council (or a person acting in his/her place) and the secretary of the Academic council.
-
3.12
Minutes of the meetings of the Academic council and their annexes shall be kept for a period of three (3) years by the secretary of the Academic council.
After three (3) years, copies of the minutes of the meetings of the Academic council shall be deposited in the archives.

3.13
Decisions by the Academic council shall be taken by a simple majority of votes of the present members of the Academic council.

3.14
Decisions of the Academic council shall be taken by open voting, unless the Academic council decides to vote by secret ballot on the agenda items.
All personal (personnel, competitive and elective) issues at meetings of the Academic council shall be decided by secret ballot.

3.15
For the purposes of secret balloting and the calculation of the results, the Academic council shall elect from among the members of the Academic council a tally committee of not less than three (3) persons by open ballot.
The Tally committee shall elect from among its members a chairperson and a secretary of the committee. Decisions of the Tally committee on each question shall be taken by a majority of votes of its members.
The members of the Tally committee according to the check list of the members of the Academic council issue ballot papers for secret voting to each member of the Academic council against their signature. After the members of the Academic council have marked the ballot papers, they are placed by the members of the Academic council in the ballot box.
At the end of the secret ballot, the tally committee opens the ballot box, counts the number of valid and invalid ballot papers and counts the votes cast "for" and "against".
The Tally committee draws up minutes of the results of the secret ballot, to be signed by all the members of the Tally committee and read out at a meeting of the Academic council.

3.16
The Academic council takes decisions in accordance with its objectives and main tasks, including on the following matters:
-
3.16.1
Research, research and clinical, and educational activities;
-
3.16.2
Scientific discoveries and inventions for awards;
-
3.16.3
Support for nomination to the Russian Academy of Sciences;
-
3.16.4
Preparation of clinical guidelines;
-
3.16.5
Nominations for honorary titles, individual and other honorary awards.

3.17
In respect of all matters of research, scientific discoveries and inventions for awards, support for nomination to academies, drafting of recommendations, decisions of the Academic council shall be taken by open voting, by the majority of votes of the members of the Academic council present at the meeting.
When filling vacant scientific posts, those re-elected for a new term, the awarding of academic titles, the presentation of honorary titles, individual and other honorary awards - by secret ballot in accordance with the provisions in force.

Rights and duties of the members of the Academic council

4.1
ПChairperson of the Academic council:
-
4.1.1
Organizes and directs the work of the Academic council;
-
4.1.2
Maintains information and analytical cooperation with federal executive bodies, executive bodies of the constituent entities of the Russian Federation and organizations on research activities in the field of medical rehabilitation and balneology, in accordance with the established procedure;
-
4.1.3
Shapes the agenda for the Academic council meeting and the list of persons invited to the Academic council meeting;
-
4.1.4
Systematically follows up on the implementation of decisions taken by the Academic council and, together with the secretary, informs the members of the Academic council thereof.
-
4.2
Vice-Chairperson:
-
4.2.1
Acts as a Chairperson of the Academic council in the absence of the latter;
-
4.2.2
Executes instructions given by the Chairperson of the Academic council, within the scope of his/her powers, within the scope of the competence of the Academic council.
-
4.3
Secretary of the Academic council:
-
4.3.1
Ensures the organization of the work of the Academic council and prepares draft work plans of the Academic council for subsequent approval, supervises their implementation and the execution of decisions taken by the Academic council and informs the members of the Academic council thereof;
-
4.3.2
Ensures coordination in the development of the main research areas of the Academic council and of plans and programmes to improve its effectiveness;
-
4.3.3
Organizes competitions to fill vacant research and teaching positions;
-
4.3.4
Participates in the organization of attestation of researchers, developing the criteria and methods for evaluation of their performance;
-
4.3.5
Reviews and prepares materials for the Academic council meeting related to dissertations, the awarding of academic titles, nomination for state awards, honorary titles, nomination to the Russian Academy of Sciences, as well as research papers and performers for State, individual and other awards;
-
4.3.6
Notifies the members of the Academic council and other invited persons of the date, time and agenda of the meeting of the Academic council, keeps and signs the minutes of the meetings of the Academic council;
-
4.3.7
Keeps the minutes of the meetings of the Academic council and their annexes for a period of three (3) years. After three (3) years, the minutes with annexes shall be sent to the archive.

4.4
Secretary of the Academic council:
-
4.4.1
Shall actively participate in the activities of the Academic council;
-
4.4.2
Shall not allow any violations of Russian law or of these provisions in his/her activities;
-
4.4.3
Shall comply with the rules of procedure for meetings of the Academic council;
-
4.4.4
Shall inform the secretary of the Academic council in advance in writing if he/she is unable to attend the meeting, the reason for his/her absence and submit his/her opinion on the items to be considered at the meeting.

4.5
Members of the Academic council may:
-
4.5.1
State their views freely;
-
4.5.2
Participate in the discussion of any matters considered at the meeting and in matters relating to the work of the Academic council;
-
4.5.3
Be elected to commissions and working groups;
-
4.5.4
Represent the Academic council at meetings, seminars, discussions, conferences, congresses and other events under the authority of and on behalf of the Academic council;
-
4.5.5
Make statements and suggestions to the Chairperson of the Academic council in order to improve the activities of the Academic council;
-
4.5.6
Make proposals for the agenda of a meeting of the Academic council

Arrangements for meetings of the Academic council
-
5.1
The secretary of the Academic council shall be responsible for the organizational, documentary and information support of the work of the Academic council.
-
5.2
The Secretary of the Academic council shall organize the preparation of the agenda of the meeting, which shall be approved by the Chairperson of the Academic council, accompanying materials (if necessary), draft resolutions of the Academic council on the issues specified in the agenda (if necessary) and send to the members of the Academic council and the persons invited to the meeting at least seven (7) days before the day of the meeting.
The Secretary of the Academic council shall also be responsible for drawing up the minutes of the meetings of the Academic council.

5.3
The persons in charge of preparing questions to be considered at a regular meeting shall submit materials to the secretary of the Academic Council by e-mail and in hard copy no later than five (5) days before the date of the meeting.

5.4
The chairperson and the secretary of the Academic council shall supervise the execution of the decisions of the Academic council, as well as the instructions given by the presiding officer during the meeting of the Academic council.
